These Terms of Service (“Terms”) govern your access to and use of The Vitality Collective websites, digital platforms, programs, memberships, educational materials, artificial-intelligence-assisted experiences, communications, and related products and services.
The Vitality Collective (“TVC,” “we,” “us,” or “our”) is operated by The Vitality Collective LLC.
By accessing our website, creating an account, purchasing or participating in a program, or using our services, you agree to these Terms.
If you do not agree to these Terms, please do not use the applicable services.
1. The Vitality Collective
The Vitality Collective provides health and wellness education, transformational programs, digital tools, coaching and guidance experiences, community resources, and related services.
Our services may include:
Educational programs
Health and wellness curriculum
Lifestyle guidance
Digital assessments and questionnaires
Artificial-intelligence-assisted guidance
Laboratory education and access to third-party laboratory services
Supplement education and access to third-party supplement providers
Wearable and biometric data integrations

Coaching or accountability services
App-based and digital health tools
Other health and wellness resources
Available services may change over time as TVC develops its platform and programs.
2. Educational and Wellness Purpose
Unless expressly stated otherwise for a particular service, TVC programs, content, digital tools, AI interactions, and wellness experiences are provided for educational, informational, wellness, and personal-development purposes.
They are not intended to serve as a substitute for individualized medical diagnosis, emergency medical care, or treatment from an appropriately licensed healthcare professional.
Information provided through TVC should be considered in the context of your individual circumstances and, when appropriate, discussed with a qualified healthcare professional.
Licensed Professional Services
Certain services may occasionally involve a physician, nurse practitioner, chiropractor, or other licensed healthcare professional.
When a licensed professional establishes a professional healthcare relationship with you, that relationship may be governed by separate:

3. No Emergency Services
TVC is not an emergency medical service.
Do not use our website, messaging systems, AI tools, community, or digital platform to obtain help during a medical emergency.
If you believe you are experiencing a medical emergency, call 911 or your applicable local emergency number or seek immediate emergency medical care.
AI systems and electronic communications may not be reviewed in real time and should never be relied upon for emergency response.
4. Artificial Intelligence and Hope
TVC may provide artificial-intelligence-assisted experiences, including an AI guide known as Hope.
Hope may assist with activities such as:
Explaining TVC educational material
Guiding users through program curriculum
Asking reflection or progress questions
Helping users understand assigned actions
Supporting implementation and accountability
Providing general educational information
Helping users navigate available TVC resources
Summarizing information provided by the user
Hope may use information you have provided, your program status, assigned curriculum, approved program protocols, previous interactions, and authorized data sources to personalize your experience.
Program-Guided AI
TVC may configure Hope to follow specific curricula, protocols, educational frameworks, decision rules, or recommendations developed or approved by TVC.
Artificial intelligence may assist in communicating and personalizing those materials.
AI-generated responses may contain inaccuracies, misunderstand context, or produce unexpected output. You should use reasonable judgment when interacting with any AI system.
AI output should not be relied upon as the sole basis for decisions involving urgent, serious, or complex medical conditions.
TVC may monitor or review AI interactions for safety, quality assurance, support, and improvement of our programs and systems.
5. Your Responsibility for Health Decisions
You remain responsible for decisions concerning your health and wellbeing.
You agree to provide accurate information when it is relevant to your participation in a program or service.
You should consult an appropriately qualified healthcare professional before making significant changes involving medications, medical treatment, or management of diagnosed health conditions.
If you experience new, severe, unusual, or worsening symptoms, seek appropriate professional evaluation rather than relying exclusively on TVC content or AI guidance.
6. Laboratory Services
TVC may provide education regarding laboratory testing and may facilitate access to testing offered by independent laboratories, marketplaces, clinicians, or other third parties.
Laboratory availability may depend on factors such as:

Age
Applicable law
Provider authorization
Laboratory requirements
Clinical eligibility
Laboratory testing may involve independent companies that maintain their own terms, privacy practices, billing policies, and professional responsibilities.
A laboratory result should be interpreted in appropriate clinical context. Reference ranges, biomarkers, and educational explanations do not independently constitute a diagnosis.
7. Supplements and Products
TVC may provide educational information about dietary supplements, nutritional products, wellness products, or related items and may provide links or access to third-party marketplaces.
Recommendations offered within a specific TVC program may reflect protocols established by TVC.
You are responsible for considering allergies, sensitivities, medications, pregnancy status, health conditions, and other factors that may affect whether a supplement or product is appropriate for you.
When appropriate, discuss supplement use with your physician, pharmacist, or other qualified healthcare professional.
Products purchased through third-party vendors are also governed by the applicable vendor's terms, fulfillment policies, return policies, and privacy practices.

If you authorize a connection, TVC may receive information such as:

Wearable-device measurements can be incomplete, delayed, inaccurate, or affected by device limitations.
TVC may use connected data to provide educational insights or personalize your program experience, but such data should not automatically be treated as equivalent to clinical diagnostic testing.
You may disconnect supported integrations subject to the functionality of the applicable platform.
9. Accounts
Certain services may require an account.
You agree to:
Provide accurate account information
Maintain the confidentiality of your login credentials
Notify us if you believe your account has been compromised
Avoid allowing unauthorized individuals to use your account
You are responsible for activity occurring through your account to the extent permitted by applicable law.
10. Eligibility

Programs intended for minors may be offered separately and may require consent from a parent or legal guardian.
By purchasing or using an adult TVC program, you represent that you are legally able to enter into these Terms.

Community participation
Your results will depend on numerous factors, including your circumstances, participation, consistency, health status, environment, and implementation.
TVC does not guarantee a specific health, financial, performance, weight-loss, symptom, or other outcome.
12. Purchases, Fees, and Payment Plans
Prices and payment terms will be disclosed at or before purchase.
Depending on the offering, you may purchase services through:
A one-time payment
Installment payments
A recurring subscription
Financing through a third party
You authorize the applicable payment processor to charge the payment method you provide according to the purchase terms you select.
If an offering automatically renews, the renewal terms and available cancellation procedures will be disclosed as required by applicable law.
Refunds and Cancellation
Refund, cancellation, and payment obligations may differ among programs and products.
The terms presented with the specific offer at the time of purchase are incorporated into these Terms and control the financial terms of that purchase.
Third-party products, laboratory testing, supplements, financing arrangements, or other services may be subject to separate cancellation and refund policies.

By providing your contact information and appropriate consent, you may receive electronic communications from TVC through channels such as:
SMS/text messaging
In-app messaging
Push notifications
Other electronic communications
These communications may include program content, educational materials, account notifications, reminders, check-ins, support messages, and other communications you have requested or authorized.
Message and data rates may apply.
You may opt out of eligible SMS communications by replying STOP or using another method provided in the message.
Opting out of some communications may limit our ability to deliver portions of a program that rely upon that communication channel.
Marketing communications will be handled according to applicable consent and opt-out requirements.
14. Community Standards
TVC may provide community spaces, group discussions, events, comments, messaging, or other opportunities for participants to interact.
When participating, you agree to communicate respectfully and refrain from:
Harassment
Threats
Discrimination
Fraud
Spam
Unauthorized advertising or solicitation
Impersonation
Illegal activity
Deliberately false or misleading health claims
Sharing another person's private information without permission
Attempting to exploit vulnerable members
Disrupting community operations
TVC may moderate or remove content and may suspend access when reasonably necessary to protect the community or enforce these Terms.
Member-Generated Health Information
Statements made by other community members represent their own experiences and opinions.
Community members are not speaking on behalf of TVC merely because they participate in a TVC community.
You should not treat another member's personal experience as individualized medical advice.
15. Privacy and Sensitive Information
Our collection and use of personal information is described in our Privacy Notice and, where applicable, any separate consumer health data privacy notice.
Please use care when sharing sensitive information in community areas visible to other participants.
Information voluntarily posted in shared community spaces may be visible to other members and should not be considered private communications with TVC.
16. Intellectual Property
Unless otherwise stated, the TVC platform and its original content are owned by or licensed to The Vitality Collective or its affiliates.
This may include:
Videos
Curriculum
Protocols
Frameworks
Assessments
Written materials
Graphics
Branding
Software
AI instructions and program structures
Educational systems
Workbooks
Training materials
Proprietary methodologies
TVC grants you a limited, personal, revocable, non-exclusive, non-transferable license to access purchased or authorized materials for your own lawful personal use.
You may not, without written authorization:
Reproduce substantial portions of TVC curriculum
Resell TVC materials
Redistribute paid content
Record or redistribute protected live sessions
Train competing AI systems using proprietary TVC content
Scrape or systematically extract TVC content
Reverse engineer proprietary features where prohibited by law
Represent TVC materials as your own
Use TVC intellectual property to create substantially derivative commercial programs
Nothing in these Terms transfers ownership of TVC intellectual property to you.
17. User Content
You may provide information, responses, comments, messages, journal entries, questions, or other content through our services.
You retain ownership of content you create.
You grant TVC the rights reasonably necessary to host, process, transmit, analyze, and use your content for providing and operating the services you request, subject to our Privacy Notice and applicable law.
This provision does not authorize TVC to sell identifiable consumer health information.
18. Testimonials and Individual Results
Testimonials, success stories, case examples, or experiences appearing on TVC websites or materials describe individual experiences.
They do not guarantee that another participant will achieve identical or similar results.
Health and wellness outcomes vary substantially among individuals.
19. Third-Party Services
TVC may integrate with or provide access to third-party services, including providers involved in:
Payments
Messaging
Artificial intelligence
Wearable-data connectivity
Laboratory services
Supplement fulfillment
Video hosting
Scheduling
Community functionality
Authentication
Cloud infrastructure
Third-party services may be governed by their own terms and privacy policies.
TVC does not control all aspects of independently operated third-party services and is not responsible for their separate acts or omissions to the extent permitted by law.
20. Acceptable Use
You agree not to:
Use the services for unlawful purposes
Attempt unauthorized access to accounts or systems
Introduce malicious code
Circumvent security measures
Interfere with platform operations
Use automated systems to scrape protected content without authorization
Misrepresent your identity
Exploit the services to harm another person
Attempt to manipulate an AI system into revealing confidential system instructions, security credentials, private user information, or proprietary information
Use TVC services in violation of applicable law
We may restrict or terminate access for material violations.
21. Service Availability and Changes
TVC is an evolving platform.
We may add, modify, replace, suspend, or discontinue features when reasonably necessary.
This may include changing technology providers, AI models, communication platforms, integrations, curriculum delivery systems, or other infrastructure.
We do not guarantee that every feature or integration will remain available indefinitely.
If a material change substantially affects a purchased service, we will address it consistent with applicable law and the terms of the applicable offering.
22. Disclaimer of Warranties
To the fullest extent permitted by applicable law, TVC services are provided on an “as available” basis.
We make reasonable efforts to provide useful, accurate, reliable, and secure services.
However, we do not warrant that:
Every service will operate without interruption
Digital systems will always be error-free
AI-generated content will always be accurate
Wearable or third-party data will always be complete
Every participant will achieve a particular outcome
Third-party services will always remain available
Nothing in this section limits warranties or rights that cannot lawfully be waived.
23. Limitation of Liability
To the fullest extent permitted by applicable law, TVC and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the services.
Any limitation of liability will apply only to the extent permitted by applicable law.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless TVC and its affiliates from claims arising from your unlawful use of the services, material violation of these Terms, infringement of another person's rights, or content you unlawfully submit through the platform.
This provision does not require you to indemnify TVC for conduct for which indemnification cannot lawfully be required.
25. Suspension and Termination
TVC may suspend or terminate access when reasonably necessary because of:

Fraud or suspected fraud
Security threats
Abuse or harassment
Nonpayment
Unlawful conduct
Conduct that creates a substantial risk to other members or the platform
You may discontinue use of our services at any time.
Ending participation does not automatically alter payment or refund obligations associated with a purchase; those obligations are governed by the applicable purchase terms and law.
26. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Any dispute not otherwise subject to a separately agreed dispute-resolution process will be handled in the courts having appropriate jurisdiction in Sheridan County, Wyoming, unless applicable law requires another venue.
27. Changes to These Terms
We may update these Terms as our services, technology, or legal obligations evolve.
When we make material changes, we will update the effective date and provide additional notice where required by law.
Changes will apply prospectively as required by applicable law.

constitute the agreement governing your use of the applicable TVC services.
If a specific signed agreement conflicts with these general Terms regarding a particular service, the specific agreement will control for that service.
